General Terms and Conditions of Advance Ticket Sales and Attendance of Events
Scope
The following General Terms and Conditions apply to advance ticket sales and the programming and attendance of events programmed by Bach-Archiv Leipzig, a foundation under German civil law, hereafter referred to as “the Bach Archive”. In particular, these include Leipzig Bachfest events as well as any other event programmed under the responsibility of the Bach Archive. If events are programmed by third parties, this is indicated expressly in the advance notice. This applies in particular to events programmed by the Leipzig Gewandhaus, Mendelssohn House, Schumann House and Leipzig Opera in the context of the Leipzig Bachfest.
I. Advance ticket sales
§ 1 Advance ticket sales agencies
Advance ticket sales over the Internet and ticket reservations by phone are handled by our sales partner, egocentric Systems GmbH. Tickets can be booked by phone on +49 (0)341-9137 333 (Mon-Fri: 9am–5pm), or booked online at www.bachfestleipzig.de.
Billing and collection of the different methods of payment available on the online shop between the customer and the Leipzig Bach Archive – purchase contracts concluded on www.bachfestleipzig.de – are handled by service provider egocentric Systems GmbH. As the authorised vicarious agent of the Leipzig Bach Archive, the latter also carries out fulfilment (payment processing) and customer service.
Advance tickets can also be purchased through the Bach Museum shop and certain advance sales agencies in Leipzig (Oelsner music shop, Ticketgalerie). § 2 Ticket prices
(1) The ticket prices quoted are the final prices, including all additional fees.
(2) Tickets remain the property of the Bach Archive until fully paid for. § 3 Concessions
(1) If discounted tickets are available, the concessions apply to the following groups of people: severely disabled (to get free admission, accompanying persons must be notified in the severely disabled person’s pass), job-seekers and recipients of Bürgergeld state benefit, schoolchildren, trainees, students and persons doing federal voluntary service. Holders of the Leipzig Pass receive a special discount.
(2) A Climate Pass is also available. This enables tourists attending the Bachfest to offset the CO² emissions resulting from their journey on a voluntary basis. The Climate Pass can be purchased on www.bachfestleipzig.de and entitles holders to a 15% discount on up to two tickets per event for certain Leipzig Bachfest events. It cannot be combined with other concessions. The Climate Pass is not transferrable. The Climate Pass cannot be used for guided tours or Bachfest events which are not programmed under the responsibility of the Bach Archive. This applies in particular to events programmed by the Leipzig Gewandhaus, Mendelssohn House, Schumann House and Leipzig Opera.
(3) The concessions above will only apply if entitlement to them is notified prior to ticket purchase. Tickets purchased at the standard price cannot be exchanged for discounted tickets even if entitlement is presented at a later date.
§ 4 Ticket returns
(1) Purchased tickets cannot be returned.
(2) If an event is cancelled or rescheduled by the Bach Archive, purchasers may rescind their purchase and the ticket will be refunded. No further damages will be paid. This does not apply if the cancellation or rescheduling is the result of gross negligence or intent by the Bach Archive. The exact procedure for obtaining a refund will be announced on www.bachfestleipzig.de as soon as the event is cancelled or rescheduled.
(3) If an event venue changes, purchased tickets remain valid. There is no requirement for an event to be programmed at a particular venue.
(4) The Bach Archive will announce the cancellation or the change of date or venue of events without delay on its web page www.bachfestleipzig.de.
(5) No substitute will be provided for expired tickets.
(6) Replacement tickets can be issued for lost tickets. To obtain a replacement, purchasers must be able to prove which ticket they purchased. Holders of original tickets take precedence over holders of replacement tickets.
II. Attendance of events
§ 1 Admission
(1) Tickets entitle holders to one attendance of the event shown on the ticket.
(2) Concession entitlements must be shown unsolicited at admission. If visitors are unable to show proof, they can pay the difference between the discounted and the standard price if there is a box office. If not, they may be refused admission to the event without a refund.
(3) Admission usually takes place 45 minutes before the start of the event. If visitors do not arrive in time for the start of the event, they have no right of admission. Late admission is at the discretion of the venue staff and is usually only possible during intervals. § 2 Performer line-up and programme changes
(1) The performer line-up is subject to change and such changes do not entitle the holder to return purchased tickets.
(2) The organiser reserves the right to make changes to announced programmes and may, if necessary, announce them at the venue. These changes entitle holders of purchased tickets to a refund only if the greater part of the announced programme content is changed.
For information on ticket refunds, see I § 4 (2). § 3 Event interruption
If an event is interrupted, a refund can only be claimed if the interruption occurred before the first interval, or (if no interval was scheduled) less than half of the scheduled duration has taken place. For information on ticket refunds, see I § 4 (2). § 3 a. Special rules for the open-air events
The risk of bad weather cannot be ruled out at the Bachfest’s open-air events. In the case of rain or uncertain weather conditions (e.g. heavy rain or storms), events may be cancelled. § 4 Poor visibility
Bach Archive events take place mainly in authentic performance venues. Given the architectural circumstances and the resulting performance constraints, seats in all price categories may offer poor or no visibility. This does not entitle purchasers to rescind a ticket purchase or claim a price reduction. § 5 Wardrobe liability
The Bach Archive is under no obligation to provide a guarded wardrobe for events it programmes. If no guarded wardrobe is available, the Bach Archive has no duty of care in this respect. If a wardrobe and wardrobe staff are provided by the Bach Archive, the Bach Archive is only liable for damage or loss in the event of intent and gross negligence. § 6 Filming and recording
(1) The Bach Archive prohibits filming and recording of any kind during events, even for private purposes. Visitors failing to comply may be told to leave the venue.
(2) If Bach Archive events are filmed or recorded for TV, Internet or print media by persons having the permission of the Bach Archive, visitors agree, by their attendance at the event, to the possible recording of images and sound, and that broadcasting or publication of these recordings does not give grounds for remuneration. § 7 Legal right to deny admission
The organiser and its representatives are responsible for enforcing the house rules and may call upon their agents and assistants, in particular concert service staff, to assist them in doing so.
Visitors must obey the instructions of the house staff.
Visitors may be denied access to the venue if there is reason to believe that they will disrupt the performance or harass staff or other visitors. Visitors may be told to leave a performance if they are disruptive, harass other visitors or occupy a seat for which they are unable to show a valid ticket. Visitors who repeatedly violate these General Terms and Conditions may also be denied admission. These visitors are not entitled to a refund of any paid admission fee or any other compensation for damages or expenses.
Visitors may not offer tickets for sale in the entrance area.
Mobile phones and other devices with acoustic signals must be switched off during performances.
III. General Provisions
§ 1 Disclaimer
The Bach Archive is fully liable for damages caused by injury to life, limb or health. The Bach Archive is also liable without limitation for the breach of essential contractual obligations (cardinal obligations).
In other respects, the liability of the Bach Archive is limited to intent and gross negligence. § 2 Final provisions
(1) The place of performance for all obligations of both contracting parties is Leipzig, insofar as the contracting partner is a businessperson, a legal entity under public law or a special fund under public law.
If the contracting partner is a businessperson, a legal entity under public law or a special fund under public law, or if the contracting partner has no general place of jurisdiction in Germany, or if the contracting partner’s place of residence or habitual abode has been transferred out of the area of application of the Code of Civil Procedure after conclusion of the contract, or if the contracting partner’s place of residence or habitual abode is unknown at the time the action is brought, the place of jurisdiction for all disputes arising from the contract is Leipzig.
(3) Should individual provisions of the General Terms and Conditions be invalid, this shall not affect the validity of the remainder of the contract.
